THIS OPTIONS ADDENDUM (this “Addendum”) is executed in conjunction with and, by this reference, incorporated into the Lot Purchase and Home Construction Agreement (the “Agreement”) dated as of April 16, 2024 by and between (“Seller”) and , (collectively, “Buyer”), respecting Lot , Block of Eden Gardens – Phase .

Buyer acknowledges that the completion of this Addendum constitutes the conclusion of the Selection Period as defined in Section 4 of the Agreement. Any changes, options, alterations and extras requested by Buyer after the Selection Period (or submittal of this document, whichever comes first) will be in Seller’s sole discretion and subject to current prices and availability. Any changes requested by Buyer and permitted by Seller Builder after the Selection Period will bear an administrative charge of One Thousand and No/100 Dollars ($1,000.00) for each individual change to be paid by Buyer, in addition to the additional cost of the change, before the change is made. Buyer understands and agrees that any changes, alterations or extras requested by Buyer will likely delay the completion of the Home, and Seller is not under any obligation to accept any change orders. Administrative charges will not be credited as earnest money at any Closing or refunded to Buyer under any circumstances.

Buyer understands and agrees that certain items, whether standard, extras, options or upgrades, such as tile, marble, stone, granite, cabinets, wood, stain, grout, wall and ceiling texturesand carpeting, are subject to size and color variations, grain and quality variations, and may vary in accordance with price, availability and changes by manufacturer from those shown in the models or in illustrations or included in Seller's Plans and Specifications or in the published list of standard items (if any). If circumstances arise which, in Seller's opinion, warrant changes in selection of suppliers, manufacturers, brand names or items, design professionals, or if Seller elects to omit certain items, Seller may modify the interior design concepts and the list of standard features or make substitutions for equipment, material, appliances, etc., whether standard or upgraded item, with items which in Seller's opinion are of equal or better quality (regardless of cost). Buyer also understands and agrees that Seller has the right to substitute or change materials and/or stain colors utilized in wood decor (if any). Buyer recognizes that certain colors as shown in displays or in the models, including, but not limited to, stone, marble, granite, cabinetry, carpeting and wood stain, will weather and fade and may not be duplicated precisely. The Total Purchase Price, as defined in the Agreement, shall be deemed to include all items, extras, options and upgrades included in this Addendum.
